Employment Discrimination

What is Employment Discrimination?

Employment discrimination is discrimination that some law or public policy makes illegal.  Laws prohibiting certain types of discrimination in the workplace are found in both state and federal law. The law makes only certain forms of discrimination or retaliation illegal.  California employment law is complex and you should always try to get knowledgeable help so you can understand your rights as an employee. In order to determine whether a certain type of discrimination is unlawful, you should speak to an attorney from an employment law firm who is an experienced employment discrimination lawyer. Cummings & Franck, P.C. has some of the best employment discrimination lawyers in the Los Angeles and Orange County area.

Discrimination Prohibited By The Fair Employment And Housing Act

The Fair Employment and Housing Act in California makes it illegal for an employer to discriminate against an employee as to the terms, conditions, or privileges of employment, or terminate an employee, because of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, pregnancy, age, or sexual orientation. Additionally, the Fair Employment and Housing Act contains the California Family Rights Act and the California Pregnancy Disability Leave Law, which makes it unlawful for an employer to discriminate against an employee as to the terms, conditions, or privileges of their employment, or terminate an employee, because they took medical leave, family leave, or pregnancy disability leave that qualifies for protection under these acts. Employment discrimination law is very complex, and an employee should always consult with an employment discrimination lawyer to determine whether their particular circumstance qualifies for protection under the law. Many employees make the mistake of thinking they are protected by an anti-discrimination law when they are actually not, or vice versa, many employees believe they are not protected by anti-discrimination law when they actually are. Cummings & Franck, P.C. has experienced discrimination lawyers in the Los Angeles area who can advise you about California employment law. For example, many times employees do not qualify for medical or family care leave protection under certain laws, like the California Family Rights Act, because the employer does not have a sufficient number of employees, the employee has not worked sufficient hours, or the employee’s illness is too minor to qualify for protection. However, many times the same employees will qualify for protection for a medical leave under different laws, like disability law. The laws regarding discrimination can be complicated and confusing, so you should always consult an experienced employment law attorney about your rights. You should always find a qualified California employment discrimination lawyer who can give you good and accurate advice.

Other Types Of Discrimination That Are Prohibited By Law

The Fair Employment and Housing Act is not the only law that that makes certain types of discrimination illegal.  There are a multitude of other laws that make other forms of discrimination illegal to include, but not limited to:  Whistleblower Protection Act, 5 USC sect. 2302, Sarbanes-Oxley Act, Protection for Employees of Publicly Traded Companies, 18 USC sect. 1514A, Major Fraud Protection Act, 18 USC sect. 1031, False Claims Act, 31 USC sect. 3730, California Whistleblower Protection Act, Government Code sect. 8547, California False Claims Act, Government Code set. 12653, as well as many laws in the California Labor Code, which protect employees.  These are only a few of the laws that prohibit discrimination, which can be found in state and federal law.  The fact is that in California there are so many laws that prohibit various forms of discrimination and retaliation it would be difficult to list them all on this website.  That’s why if an employee believes they are being discriminated against for any reason, they should always contact a qualified employment attorney to determine whether it is unlawful employment discrimination.
